Thank you for visiting our website. This website is operated by Nutrafruit Pty Ltd (ABN: 25 138 385 154). By accessing and/or using this website and related services, you agree to these Terms and Conditions, which include our Privacy Policy (Terms). You should review our Privacy Policy and these Terms carefully and immediately cease using our website if you do not agree to these Terms.

In these Terms, ‘us’, ‘we’ and ‘our’ means Nutrafruit Pty Ltd and our related bodies corporate.

These Terms may be updated from time to time without notice to you so please do check the terms and policy regularly.

If you are shopping through our online store, our Terms of Purchase will also apply to you.

1.  Registration

You may need to be a registered member to make orders via our website.

When you register and activate your account, you will provide us with personal information such as your name; email address; telephone number; address; credit card details. You must ensure that this information is accurate and current. We will handle all personal information we collect in accordance with our Privacy Policy.

When you register and activate your account, we will provide you with a user name and password. You are responsible for keeping this user name and password secure and are responsible for all use and activity carried out under this user name.

To create an account, you must be:

  • at least 18 years of age;
  • possess the legal right and ability to enter into a legally binding agreement with us; and
  • agree and warrant to use the website in accordance with these Terms.

2.  Accuracy, completeness and timeliness of information

The information on our website is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on our website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this website. You should monitor any changes to the information contained on this website.

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this website or a linked website. You must take your own precautions to ensure that whatever you select for your use from our website is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.

We may, from time to time and without notice, change or add to the website (including the Terms) or the information, products or services described in it. However, we do not undertake to keep the website updated. We are not liable to you or anyone else if errors occur in the information on the website or if that information is not up-to-date.

3.  Promotions and competitions

For certain campaigns, promotions or contests, additional terms and conditions may apply. If you want to participate in such a campaign, promotion or contest, you need to agree to the relevant terms and conditions applicable to that campaign, promotion or contest. In case of any inconsistency between such terms and conditions and these Terms, those terms and conditions will prevail.

4.  Terms of Purchase

4.1 How to buy our products

Customers can buy our products at any of the off-line retail outlets that carry stock. Refer to our website for Where To Buy [add link in here] details.

Alternatively, customers can buy online at https://shop.nutrafruit.com.au.

All costs, including postage and handling costs are shown during the ordering process and before payment is made.

4.2 Online Order confirmation

After successfully placing an order online, you will receive an Order Confirmation email showing the details of your order. Please note that this email is generated automatically – if your email address is not entered correctly you may not receive this or any subsequent email from us. Please check that the order details are correct – contact us by replying to the Order Confirmation email if any of the order details are incorrect.

4.3 Pricing policy

Unless stated otherwise, all prices on our website are shown in AUD and include GST where applicable.

4.4 Payment methods and security

Online purchases may be paid for using standard credit cards such as Visa; Mastercard; Diners; or American Express; by using PayPal or by Direct Deposit to our bank account.
Please contact us if you wish to use an alternative payment method.

4.5 Purchasing limits

Unless stated, there are no purchasing limits for any of our products. The online ordering system is currently set to accept a maximum of 9 packs (90 bottles) of QG nectar – please contact us if you wish to order more than this.

QG nectar is dispatched in cartons of 1 pack (10 bottles); 2 packs (20 bottles) or 3 packs (30 bottles). Postage costs per bottle are generally reduced by buying in lots of 3 packs.

4.6 Deliveries and insurance

Most deliveries are made using Australia Post. We do use couriers where necessary and by request.

You will receive an email notification from us when we dispatch your order and from Australia Post when they have your order and during the delivery process.

Orders will normally be despatched from our warehouse in Brisbane, Queensland within 48 business hours of your order being received and paid. In most cases, please allow 5 to 10 days for delivery by Australia Post within Australia. Allow longer times for overseas delivery.

Sometimes, deliveries do go astray – in this case, contact Australia Post first and, if this does not resolve the issue, contact us.

Lost or damaged deliveries are generally covered by insurance.

4.7 Order Processing

Orders shall only be processed by us on the basis of payment of the order in full has been made at the time the order is processed.

Nutrafruit has the sole legal right to determine to refund, backorder or supply new or replacement items on any order that is delivered with missing or incorrect items.

Nutrafruit will always endeavor to deliver all goods as requested on time but are not responsible or legally liable for any delays in delivery.

If products are ordered by us specifically to fulfil an order, no returns, changes or cancellations will be accepted.

4.8 Changes & Cancellations

If the ordered quantity or product from the customer is altered after quoting, the price is subject to change.

If goods are ordered specially and manufactured to customer specifications and supplied to these specifications the above mentioned goods cannot be returned for credit.

Nutrafruit reserves the right to adjust or amend prices in accordance with any alteration of changes to tax legislated by the Australian or other Government where such change affects the cost of the products supplied.

4.9 Urgent Orders

Nutrafruit will endeavour to meet customer requests for urgent delivery of orders, however any additional expense incurred will be passed on to the customer for payment before the order can be processed.

Nutrafruit is not in any way liable for any goods not received at any destination on or by any particular due date.

4.10 Payment Terms

Full payment is required prior to any orders being processed or dispatched.

The customer must pay for goods supplied according to payment terms on this website. All deliveries may be suspended or held should these terms not be met at any time.

4.11 Clerical Errors

We strive to provide a seamless customer experience. However, if we have made an error with your order or you receive a faulty product, please contact us to resolve the matter.

Clerical errors are subject to correction without notification.

4.12 Return & Exchange

Any items that arrive broken or faulty will be replaced if we are notified within 7 days of receipt. For items that arrive broken or damaged, please email us a photograph within 7 days at orders@nutrafruit.com.au and the item will be promptly replaced.

If you are unhappy with any of your purchases you may return them within 7 days of receipt for a full credit valid for 30 days.

Please note that we do not accept returns on sample items.

4.13 Purchasing guarantees

If you place an order with us we will deliver the products even if the item has fallen out of stock.

Any items that arrive broken or faulty will be replaced if we are notified within 7 days of receipt. For items that arrive broken or damaged, please email us a photograph within 7 days at orders@nutrafruit.com.au and the item will be promptly replaced.

If you are unhappy with any of your purchases you may return them within 7 days of receipt for a full credit valid for 30 days.

Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in this website and in all of the material (including all text, graphics, logos, audio and software) made available on this website (content).

Your use of this website and use of and access to any content does not grant or transfer any rights, title or interest to you in relation to this website or the content. However we do grant you a licence to access the website and view the content on the terms and conditions set out in this Agreement and, where applicable, as expressly authorised by us and/or our third party licensors.

To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about this website or the content, including but not limited to warranties or representations that they will be complete, accurate or up-to-date, that access will be uninterrupted or error-free or free from viruses, or that this website will be secure.
We reserve the right to restrict, suspend or terminate without notice your access to this website, any content, or any feature of this website at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

In Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms & Conditions purports to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the Australian Competition and Consumer Act and other laws. Any and all other warranties and guarantees which are not guaranteed by the Australian Consumer Law or the Competition and Consumer Regulation 2010 are expressly excluded where permitted, including liability for incidental or consequential damages caused by breach of any express or implied warranty or condition.

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of our website and/or the information or materials contained on it, or as a result of the inaccessibility of this website and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

10.  Product Reviews

To comply with Australia laws, we are required to monitor all publicly posted product reviews on our website and in accordance with Australian laws, remove any of these reviews if they appear fake, offensive, defamatory or irrelevant. This also includes reviews that imply a product has caused any medical conditions including allergies or reactions. Star ratings on reviews cannot be altered by us, but we may need to edit reviews on occasion to omit words which appear defamatory or offensive. If you have had a review modified by us and you disagree with the modification, you may contact us on orders@nutrafruit.com.au for any further clarification on review monitoring. Please note that if you contact us, we can amend reviews so they can still be posted rather than removed all together.

11.  Jurisdiction and governing law

Your use of the website and these Terms are governed by the law of Queensland and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Queensland.
